On August 13, 2019, Council passed a motion to direct staff to prepare a by-law to prohibit open doors and windows when air conditioning is in operation and requested By-Law Officers to more aggressively enforce both the Anti-idling By-Law and, if passed, the future by-law to discourage open doors and windows when air conditioning is in operation. For a review of the full draft bylaw being proposed. The draft of this bylaw is going before Council on May 17th for approval.

This By-Law does not apply to:

  • garage-style Doors or Windows; Doors or Windows that adjoin indoor seating areas where food or beverages are served and which link such areas to outside patios;
  • Doors or Windows that allow for direct service of food or beverages to outdoor space;
  • and Doors and Windows in commercial bakeries that are kept open to maintain reasonable internal temperatures while using high heat sources in the ordinary course of business.

Offence and Penalty Provisions:

Every Person, other than a corporation, who breaches any provision of this ByLaw, or contravenes an order issued under this By-Law, is guilty of an offence, and on conviction, is liable to a fine of not more than $10,000 for a first offence and $25,000 for any subsequent offence.

Every corporation that breaches any provision of this By-Law, or contravenes an order issued under this By-Law, is guilty of an offence, and on conviction, is liable to a fine of not more than $50,000 for a first offence and $100,000 for any subsequent offence.
